Subhan Rental Services is a registered business name of The Allana Group Pty Ltd (ABN 66 685 656 697). In this policy, "we", "us" and "our" mean The Allana Group Pty Ltd trading as Subhan Rental Services.
We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains how we collect, hold, use and disclose personal information, and how you may access it, correct it, or complain about how we have handled it.
1. Personal information we collect
We collect only what we need in order to hire a vehicle to you lawfully and safely:
- Identity information: full name, date of birth, and residential address.
- Contact information: telephone number and email address.
- Driver licence information: licence number, class, conditions, expiry, and issuing jurisdiction, for Australian and overseas licences, together with any International Driving Permit or accredited English translation you rely on.
- Verification documents you provide, such as proof of residential address.
- Rental and payment records: booking history, the booking confirmation payment, security bond, weekly rent, and any deduction made and the reason for it.
- Driving and incident records relating to a vehicle you hire, including tolls, infringements, damage reports and insurance claims.
- Website usage information collected through Google Analytics, described at clause 8.
A driver licence number is a government related identifier. Consistent with APP 9, we use and disclose it only for the purposes described in this policy, and we do not adopt it as our own identifier for you.
2. How we collect it
We collect personal information directly from you wherever it is reasonable and practicable to do so: through this website, by telephone, by WhatsApp, by email, and in person at pickup. We may also receive information from our insurer, from a repairer, from a toll operator, or from a government agency where an incident, claim or infringement involves a vehicle you hired.
3. Why we collect it, and what happens if you do not provide it
We collect and use personal information in order to verify your identity and your eligibility to drive, to assess and manage a rental, to process payments and the security bond, to maintain and insure our vehicles, to respond to incidents, infringements and claims, to meet our obligations under Victorian road transport law and Australian taxation law, and to contact you about your rental.
If you choose not to provide the information described at clause 1, we will not be able to supply a vehicle to you.
4. Disclosure
We do not sell personal information, and we do not disclose it for any purpose unrelated to your rental. We disclose it only:
- to our payment provider, in order to process a payment;
- to our insurer, loss assessor or repairer, where damage or a claim requires it;
- to a toll operator, Victoria Police, or another enforcement agency, where required or authorised by law - including where we are required to nominate the driver of a vehicle at the time of an offence under section 84BE of the Road Safety Act 1986 (Vic);
- to a debt recovery agent or legal advisor, where an amount properly owing under a rental remains unpaid;
- to a court or tribunal, where required by law or by an order.
5. Direct marketing
If we send you marketing about our vehicles or offers, every message will identify us and will contain a functional unsubscribe facility, consistent with the Spam Act 2003 (Cth). You may opt out at any time using that facility or by contacting us at clause 11, and we will action it promptly and at no cost to you. We do not supply your contact details to another organisation for that organisation to market to you.
6. Security, and what we do if something goes wrong
We hold personal information on access-controlled systems, and we limit access to those staff who need it to perform their role. We take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, modification or disclosure.
If we suffer a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner, as required by the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act 1988 (Cth).
7. How long we keep it
We retain rental, identity and payment records for the period required by Australian taxation law and Victorian road transport law, and for so long as a claim relating to a rental could still be brought. When we no longer need personal information for any purpose for which it may lawfully be used, we destroy it or de-identify it.
8. Analytics, cookies and overseas disclosure
This website uses Google Analytics, which sets cookies and collects information about how the site is used, including pages viewed, approximate location, device and browser. That information may be stored and processed outside Australia, including in the United States. You may disable cookies in your browser, or install the Google Analytics opt-out browser add-on, without losing access to any part of this site.
Signing in with Google is optional. Where you use it, Google discloses to us only your name, email address and profile image.
9. Accessing and correcting your information
You may ask us for access to the personal information we hold about you, and you may ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details at clause 11. We will respond within a reasonable period, and ordinarily within 30 days. We do not charge for making a request. If we refuse access or correction, we will tell you why in writing and how you may complain.
10. Complaints
If you believe we have breached the Australian Privacy Principles, please contact us first using the details at clause 11, so that we have an opportunity to resolve it. We will acknowledge your complaint promptly and respond substantively within 30 days.
If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner: telephone 1300 363 992, or online at oaic.gov.au.
